Terms of usage
Shenzhen Sole Network Science & Technology Co. Ltd.(hereinafter referred to as “Sole company”) here reminds you（users）, before registering as our users, please read this 《User agreement》(hereinafter referred to as “agreement”) carefully, so that you can fully understand all terms of this agreement. Please read carefully, and decide whether to accept this agreement. Unless you accept all terms of this agreement, you have no rights to register, login or use services related to this agreement. Your actions of registering, login and using mean that, you already accept this agreement and agree to accept restrictions of all terms of this agreement. This agreement describes rights and obligations between Sole company and users about “Suremax” software service(hereinafter referred to as “service”). “Users” are individuals, who register, login and use this service. This agreement may be updated by Sole company at any time and once the updated agreement terms released, they’re considered to replace the previous ones automatically, we don’t promise a further notice, and users may check the latest version of agreement terms in this website. After Sole company amends agreement terms, if users don’t accept revised terms, please immediately stop using our service, or it means that they accept revised terms. Norms of content 1. Content of this article is any contents that users in the process of using this service create, upload, copy, release and disseminate, including but not limited to registration and identification information, such as account images, names, users’ statements etc., or messages of text, voice, photo, video, graphic, etc. for sending, replying or automatic replying and related link pages, and other contents caused by using account or this service. 2. Users are not allowed to use “Suremax” account or this service to create, upload, copy, release and disseminate the following contents prohibited by laws, regulations and policies: Contents against the basic principles of Constitution; Contents may do harm to national security, leak national secrets, subvert state power and undermine national unification; Contents may do harm to national honor and interests; Contents may incite ethnic hatred or discrimination, undermine national solidarity; Contents may destroy state religious policy, propagate cult and feudal superstition; Contents spreading rumors, disrupting social order, undermining social stability; Contents spreading obscenity, pornography, gambling, violence, homicide, terror or abetting; Contents insulting or slandering others, infringing legal rights and interests of others; Contents including other information prohibited by laws and regulations. 3. Users shall not use “Suremax” account or this service to create, upload, copy, release and disseminate the following contents, that may interfere with the normal operation of “Suremax”, and violate the legal rights and interests of other users or the third party: Contents containing any sex or sexual suggestions; Contents containing insults, intimidation and threats; Contents containing harassment, spam, malicious information and decoy information; Contents involving others’ privacy and personal information; Contents violating others’ legal rights, such as right of reputation, right to portrait, intellectual property right, commercial secrets etc.; Contents containing other information that may interfere with the normal operation of this service, and violate the legal rights and interests of other users or the third party. Rules of usage 1. Any contents, that users transmit or release in this service or through this service, do not reflect or represent, or should be thought to reflect or represent Sole company’s opinions, positions or policies, our company does not bear any responsibilities to this. 2. Users shall not use “Suremax” account or this service to carry out the following acts: Submitting, releasing false information, or stole someone’s head portrait or information, to impersonate, use the name of the other person; Enforcing, inducing other users to follow, click on the link pages or share information; Making up facts and concealing the truth to mislead, deceive others; Using technical means to batch build false accounts; Using “Suremax” account or this service to commit any illegal and criminal activities; Creating, releasing methods, tools related to above-mentioned acts, or operating, disseminating these methods, tools, no matter if these acts are of commercial purposes; Other acts, against the provisions of laws and regulations, violating other users’ legal rights and interests, interfering with the normal operation of “Suremax” or acts not clearly authorized by Sole company. 3. Users need to take full responsibility for the authenticity, legality, harmlessness, accuracy, validity, etc. of the messages transmitted by using “Suremax” account or this service, any legal responsibilities relevant to users’ disseminating messages, should be taken by users themselves, it has nothing to do with Sole company. If this caused damages to our company or the third party, users should make relevant compensation in accordance with laws. 4. There may be advertisements in the service Sole company provided, users should agree to show advertisements provided by our company and third-party suppliers, partners in their using process. Except situations clearly stipulated in laws and regulations, users should take their own responsibility for transactions conducted according to this advertising information. Sole company does not bear any responsibility for the loss or damage, caused by transaction according to this advertising information or content provided by before-mentioned advertisers. Risk-taking 1. Users understand and agree, that “Suremax” is only a platform, providing services of information sharing, disseminating and obtaining, they must take responsibility for all acts under their own registered accounts, including any content transmitted by users and any consequences resulted from this. Users should make their own judgment on “Suremax” and content of this service, and assume all risks arising from using this content, including risks due to dependence on content’s accuracy, integrity or practicability. Sole company can not and will not take responsibility for any loss or damage caused by users’ behavior. If users find any violation of this agreement or other inappropriate use of this service, please immediately report or complain to Sole company, we will handle that in accordance with this agreement. 2. Users understand and agree, that because of business development, Sole company reserves rights of unilateral modifying, suspending, terminating or revoking the whole or partial content of this service, users need to take this risk. Intellectual property statement 1. In this service, except intellectual property referring to advertisements belongs to respective advertisers, intellectual property on the content(including, but not limited to, web pages, text, images, audio, video, graphics etc.) provided by Sole company in this service is all reserved by Sole company, unless before using this service users already lawfully acquired intellectual property on released content. 2. Except for specific statements, copyright, patent rights and other intellectual property on the software, on which Sole company relies while providing services, are all reserved by Sole company. 3. The images, texts or their combination, and other logos, products, service names(hereinafter referred to as “Sole company logo”), to which Sole company refer in its service, their copyright or right of trademark all belongs to Sole company. Without prior written consent of our company, users should not in any way display, use or deal with company logo, but also indicate to others, that they have the right to display, use or deal with it. 4. Above-mentioned and any other intellectual properties lawfully owned by Sole company or related advertisers, are protected by laws, without the written permission of Sole company or related advertisers, users should not in any way use or create relevant derivative works. Legal responsibility 1. If Sole company finds or receives others’ reports or complaints, that users violate this agreement, company has the right at any time to review, delete relevant content without notifying, including, but not limited to, users’ information, chatting records, and depending on the gravity of the violation, impose punishments on illegal account, including, but not limited to, warning, account banning, device banning, function banning, and at the same time notify users to deal with that. 2. Those users, who have violated user agreement, their banned functions will get recovered by the expiration of banning period. Banned users may submit complaints in relevant web page of Sole company site, we will go through complaints and make our own reasonable judgment to decide if change punishment measures. 3. Users understand and agree, that relying on reasonable judgment Sole company has the right to impose punishments on violation of relevant laws, regulations or this agreement, take appropriate legal actions on any users, who violate laws and regulations, and keep relevant information according to laws and regulations so as to report to relevant departments, users should bear all legal responsibility resulted from this. 4. Users understand and agree, that any claims, requirements or losses proposed by any third parties, that’s caused or created by users’ violation of this agreement, including reasonable attorney’s fees, users should compensate Sole company, cooperating companies and related companies, and keep them from suffering damages. Force majeure and other excuses of exemptions 1. Users understand and confirm, that in the process of using this service, they may be encountered with risk factors, such as force majeure, which may lead to an interruption of this service. Force majeure refers to objective events, that can’t be predicted, overcame and avoided, which have significant effects on one or two parties, including, but not limited to, natural disasters, such as floods, earthquakes, plagues and storms, as well as social events, such as wars, unrests, government actions, etc. In such cases, Sole company will try hard to response in the first time to cooperate with relevant units. But resulted losses caused to users or third parties, Sole company and cooperating units will be exempted from them in the extent permitted by laws. 2. The service, like most internet services, could be affected by various factors, including, but not limited to, users’ reasons, network service quality, social environment, etc., could get involved in variety of security issues. For example, the harassment in real life because of misusing of users’ information by other people; The other software users download and install or websites users visit, contain the virus “Trojan horse”, which threatens the security of users’ computer information and data, which may in turn affect the normal use of the service, and so on. Users should strengthen the awareness of information security and protection of users’ information, pay attention to strengthen the password protection in order to avoid losses and harassment. 3. Users understand and confirm, that there may exist risks of interrupting the service or failing to meet users’ requirement because of force majeure, computer virus or hacker attacks, unstable system, user location, user power off and any other reasons of technology, internet, communication lines. And any losses of users or third parties, caused by above-mentioned issues, Sole company does not take any responsibility. 4. Users understand and confirm, that in the process of using this service, there may be misleading, fraudulent, threatening, defamatory, offensive or illegal information, or anonymous or pseudonymous information violating others’ rights, as well as actions accompanying this kind of information, which may lead to users’ or third parties’ any losses, Sole company does not undertake any responsibility. 5. Users understand and confirm, that Sole company needs to regularly or irregularly examine, repair or maintain “Suremax” platform or related equipment, if in this situation service get disrupted for a reasonable time, Sole company does not need to take any responsibility, however it should notify in advance. 6. According to laws, regulations and provisions of this agreement, Sole company has the right to deal with illegal or default content, but this right does not constitute Sole company’s obligations or commitments, we can not ensure to timely find violation actions of laws, regulations or agreement, or deal with them. 7. Users understand and confirm, that while Sole company provides the following products or service, their quality defects and any losses arising from this, Sole company does not need to take any responsibility. Free service that Sole company provides to users; Any products or service that Sole company presents to users. 8. In any cases, Sole company does not take responsibility for any indirect, consequential, punitive, incidental, special or penalty damages, including profit losses that users have suffered because of using “Suremax” or this service (even Sole company has been told about the possibility of such losses). Although this agreement may contain contrary provisions, all responsibility our company takes for users, no matter for what kind of reason or behavior, will not beyond the charges (if there are) that users have paid for our company’s service. Change, interruption and termination of the service 1. In view of particularity of network services, users agree, that Sole company has the right at any time to change, interrupt or terminate part or all of the service (including chargeable service). But before this, our company should notify users, and provide those affected users equivalent alternative service; If users are not willing to accept the alternative service and they already have paid our company fees, we should after deducting relevant costs according to their actual usage of services, refund the remaining fees to their Sole accounts. 2. If any of the following situations occurs, Sole company has the right to change, interrupt or terminate their free or charged services for users, and we don’t need to take any responsibility for users or any third parties; According to laws and regulations, users should submit real information, but the personal information they have provided is not real, or does not consist with the registered information, and they failed to provide reasonable proofs; Users have violated relevant laws and regulations or provisions of this agreement; According to provisions of laws or requirements of authorities; For security reasons or other necessary situations. Others 1. Sole company solemnly reminds users to pay attention to the provisions of this agreement, which have stipulated the exemption of our company’s responsibility and restrictions of users’ rights, please read that carefully, and consider the risk independently. Juveniles should be accompanied by legal guardians while reading this agreement. 2. The validity, explanation and the solution of disputes of this agreement apply to Law of the people’s Republic of China. If there are any disputes between users and Sole company, they should settle it friendly through negotiation, if the negotiation fails, users agree to submit disputes to people’s court of our company’s domicile for jurisdiction. 3. In case that any provisions of this agreement become invalid or out of performability because of any reasons, the remaining provisions are still valid and bind upon both parties. The right of final explanation of this regulation is reserved by Shenzhen Sole Network & Technology Co., Ltd.
